I disagree with the case. This is because this is going against the first ammendment; mainly freedom of speech. People should be aloud to voice their poinion about the government if they are doing a bad job running it, and they definitely should be able to overthow it. Why? Because the first ammendment says so. And the Communist Party was pretty realistic in America, but they honestly wouldn't get that far. This is because our government over-powers them which is why we don't have communism today
This case was about how a few man had violated the Smith Act, because they were teahcing their views on Communisim and thye were arrested and imprionsed. Also
I believe this is a diffcult question to answer. I believe that all the amendments written in the bills of rights should be honored , but when it comes down to a situation of panic , sometimes the rules must be bended. If i had to chose i side i would say i would disagree with this cases ruling. They shoould not have imprisoned those men, just because they were exerxsing their first amendment rights.
I dont think it should be aganist the law, only in a circimstance when the governemnt is abusing their power and not taking care of their people.
I dont believe their was a real threay of an overthrow, i just think some poeple saw that communist was a better plan, and their was no record in history of any one trying to take over the governemt duirng the "Cold War"
i dont agree with the outcome of this case because the first amendment gives every citizen the right to say whatever they want, however the Smith Act The Act made it unlawful to knowingly teach and advocate the overthrow of the US government. as long as the US government isnt corrupt, you cant overthrow it, but it is always legal to talk about it. the communist threat in america was semi-realistic because even though mcCarthy didnt find aa single russian spy, it was still belived that there were communists trying to overthrow the US governmetn.
